MATERIAL CONSIDERATIONS explained

For objections to be considered in the planning decision making process they have to be Material Considerations relevant to the application.

What constitutes Material Consideration has been defined in law and we have included a list of areas of material considerations below.

Material Considerations:

  • Central government policy and guidance – Acts, Circulars, Planning Policy Guidance Notes (PPGs) etc.
  • The Development Plan – and any review of the Development Plan which is underway.
  • Adopted supplementary guidance – for example. village design statements, conservation area appraisals, car parking standards.
  • Replies from statutory and non-statutory agencies (e.g. Environment Agency, Highways Authority).
  • Representations from others – neighbours, amenity groups and other interested parties so long as they relate to land use matters.
  • Effects on an area – this includes the character of an area, availability of infrastructure, density, over-development, layout, position, design and external appearance of buildings and landscaping
  • The need to safeguard valuable resources such as good farmland or mineral reserves.
  • Highway safety issues – such as traffic generation, road capacity, means of access, visibility, car parking and effects on pedestrians and cyclists.
  • Public services – such as drainage and water supply
  • Public proposals for using the same land
  • Effects on individual buildings – such as overlooking, loss of light, overshadowing, visual intrusion, noise, disturbance and smell.
  • Effects on a specially designated area or building – such as green belt, conservation areas, listed buildings, ancient monuments and areas of special scientific interest.
  • Effects on existing tree cover and hedgerows.
  • Nature conservation interests – such as protection of badgers, great crested newts etc.
  • Public rights of way – more information on these is available from the Countryside Team
  • Flooding or pollution.
  • Planning history of the site – including existing permissions and appeal decisions.
  • A desire to retain or promote certain uses – such as playing fields, village shops and pubs.
  • Need for the development – such as a petrol station
  • Prevention of crime and disorder
  • Presence of a hazardous substance directly associated with a development
  • Human Rights Act
  • Precedent – but only where it can be shown there would be a real danger that a proposal would inevitably lead to other inappropriate development (for example, isolated housing in the countryside)

You can post or hand deliver your letter of objection to the Planning Office , even after 11th September deadline.

Please make sure you send it in as soon as possible to ensure your objections are considered.

You can include pictures with your ojections letter. Best to make sure they are referred to in the letter.

Anyone on the mainland, maybe friends or relatives who visit, can object.

– Even if you have already sent in an objection you can still send in another with additonal concerns.

But only for ONLINE OBJECTIONS which have to be received by the Planning Office by 11th September 2020

It is still possible to send in objections after 11th September by EMAIL or LETTER whilst the report for the planning committee is being put together and the planning decision has yet to be taken.
It is best to get your objection in sooner rather than later as you may miss the opportunity for your objections to be considered.

Can anyone Object to Planning ?

Yes.

Even if you do not live nearby you can still object if you are affected in some way by the planning proposal.

A friend or relative from the mainland that visits the Isle of Wight can also be affected by the proposed change so is justified in submitting their objections to the application.

There is no age limit so children under 18yrs can object.

Remember:

All members of a household can submit objections individually and each one will then be counted as separate submissions in the total of objections received.

Avoid Joint Objections, why does this matter ?

If you submit a joint objection it will only count as one objection received.

If however each person sends in separate objections, even with similar content but clearly sent by different individuals, then each will count and the total number of objections received will be increased.

I hear I can send in more objections even if I have already made one, is this true ?

Yes.

There is no limit to points of objection you may submit.

Please make sure they are about ‘Material Considerations’ relevant to the planning application (please see elsewhere on this page for explanation of Material Considerations).
If say for example you had a realisation you didn’t have before, or become aware of information or facts you didn’t know before then submit further objections and both will be considered.

And you can always send them in by email or letter after the 11th September deadline

Can I send pictures and videos in with my Objections ?

Yes.

You can send them as attachments to emailed objections, or include pictures with posted or hand delivered objections.

You cannot attach/upload images when using the online IW Council Planning portal to object.

ONLINE OBJECTION PROCESS:

STEP 1

If you haven’t done so already, you will first need to register on the IW Planning Portal. It’s very easy. This link will take you to the registration page.

The IW Planning Portal will verify your email address during this process, sometimes this email can be received in your spam or junk folder so check there as well.
Once you have clicked the link in the verification email you are set to login to the planning portal whenever you want, and this will enable you to submit your online objections (comments).

STEP 2

The planning portal has a time limit when logged in, so it is best to write your objection statement beforehand. You can then have it ready to copy and paste once logged in.

Please try and include something in your own words, even if it is accompanied by similiar facts and statements used by others. We have also provided a list of objections others have submitted that you may wish to refer to or use.

STEP 3

When you’re ready, login to the planning portal using the link below.
Click Search button, select Planning/Simple Search.
Type   20/01061/FUL   in the search box, click Search and this will take you to the main page for this planning application.

If wish to submit your objections online then you’ll first need to be registered on the IW Planning Portal. This is easy to do if you haven’t done so already.

The IW Planning Portal will need to verify your email address during registration by sending you a verification email.
