MATERIAL CONSIDERATIONS explained

For objections to be considered in the planning decision making process they have to be Material Considerations relevant to the application.

What constitutes Material Consideration has been defined in law and we have included a list of areas of material considerations below.

Click to Download:

PDF – Material Considerations Explained

Word docx – Material Considerations Explained

Material Considerations:

  • Central government policy and guidance – Acts, Circulars, Planning Policy Guidance Notes (PPGs) etc.
  • The Development Plan – and any review of the Development Plan which is underway.
  • Adopted supplementary guidance – for example. village design statements, conservation area appraisals, car parking standards.
  • Replies from statutory and non-statutory agencies (e.g. Environment Agency, Highways Authority).
  • Representations from others – neighbours, amenity groups and other interested parties so long as they relate to land use matters.
  • Effects on an area – this includes the character of an area, availability of infrastructure, density, over-development, layout, position, design and external appearance of buildings and landscaping
  • The need to safeguard valuable resources such as good farmland or mineral reserves.
  • Highway safety issues – such as traffic generation, road capacity, means of access, visibility, car parking and effects on pedestrians and cyclists.
  • Public services – such as drainage and water supply
  • Public proposals for using the same land
  • Effects on individual buildings – such as overlooking, loss of light, overshadowing, visual intrusion, noise, disturbance and smell.
  • Effects on a specially designated area or building – such as green belt, conservation areas, listed buildings, ancient monuments and areas of special scientific interest.
  • Effects on existing tree cover and hedgerows.
  • Nature conservation interests – such as protection of badgers, great crested newts etc.
  • Public rights of way – more information on these is available from the Countryside Team
  • Flooding or pollution.
  • Planning history of the site – including existing permissions and appeal decisions.
  • A desire to retain or promote certain uses – such as playing fields, village shops and pubs.
  • Need for the development – such as a petrol station
  • Prevention of crime and disorder
  • Presence of a hazardous substance directly associated with a development
  • Human Rights Act
  • Precedent – but only where it can be shown there would be a real danger that a proposal would inevitably lead to other inappropriate development (for example, isolated housing in the countryside)

How to Object to the Planning Application 20/01060/FUL ?

You can object to the planning application 20/01060/FUL in the following ways:

– by Email (can include pictures)
– by Letter, posted or by hand (can include pictures)
– Online (online objection deadline 11th September has now passed)

There are detailed How To’s on this web page for each of the above ways.

You can EMAIL OR POST OBJECTIONS AFTER 11th SEPTEMBER before the Planning Officer’s report to the Planning Committee is completed and the planning decision is taken by the committee.

Please try to get objections in as soon as possible to ensure they are considered and included.

Material Considerations, what are they and do they matter?

For Objections to be considered in the planning decision making process they have to be Material Considerations relevant to the application. The areas of planning concerns that are Material Consideration has been defined in law.
We have included a list of areas of Material Considerations for planning decisions on this How To page.

Click:   Objections to use for this particular planning application 20/01061/FUL

We have also created an OBJECTIONS LIST you may wish to consider, use or copy and paste when sending in your objections. The list includes information submitted by others in objecting to this application.

The Objections List is continually being updated so if you have a concern about this planning application that is not on the list then please let us know and we can include for others to be aware of.

Please when submitting your objections write in your own words as much as possible, even if you are commenting about the same concerns as others. It is important that the objection is seen to be comment by you.

IMPORTANT:

– Numbers matter…It is important to send in your objections even if they are the same concerns others have submitted. In planning the level of public concern does matter, and numbers of objections received are important.

– Avoid sending in objections in joint names.
Every member of your household can object separately and there is no age limit. Children can send in objections, they are after all part of the community and they can be impacted and have concerns like anyone else. Each submission individually sent in will count separately towards the total number of objections received.

– You do not have to live local to the application area to object.
Anyone on the Isle of Wight can object.
Anyone on the mainland, maybe friends or relatives who visit, can object.
…if you will be affected in some way by the proposed development, put in an objection.

– Even if you have already sent in an objection you can still send in another with additonal concerns.

11th September Deadline - does it matter ?

Yes

But only for ONLINE OBJECTIONS which have to be received by the Planning Office by 11th September 2020

However

YOU CAN STILL SUBMIT OBJECTIONS BY EMAIL OR LETTER after 11th September

Please click:

OBJECT BY EMAIL  or  OBJECT BY POST

It is still possible to send in objections after 11th September by EMAIL or LETTER whilst the report for the planning committee is being put together and the planning decision has yet to be taken.
It is best to get your objection in sooner rather than later as you may miss the opportunity for your objections to be considered.

SO GET YOUR OBJECTIONS IN AS SOON AS YOU CAN

Planning Application Documents for application 20/01061/FUL (Westridge Farm) - how can I access them ?

The planning documents are public access. You don’t have to register on the IW Council’s Planning Portal to access them or information about the application.

This link will take you to the main page for this application.

Isle of Wight Council, Planning Portal, Planning Application 20/01061/FUL

The Planning Application number is   20/01061/FUL
And it is referred to as ‘Land South Of Appley Road North Of Bullen Road And East Of Hope Road (West Acre Park) Ryde Isle Of Wight’

There are lots of documents but don’t let this put you off. The main ones to look at are:

Can anyone Object to Planning ?

Yes.

Even if you do not live nearby you can still object if you are affected in some way by the planning proposal.

A friend or relative from the mainland that visits the Isle of Wight can also be affected by the proposed change so is justified in submitting their objections to the application.

There is no age limit so children under 18yrs can object.

Remember:

All members of a household can submit objections individually and each one will then be counted as separate submissions in the total of objections received.

Avoid Joint Objections, why does this matter ?

If you submit a joint objection it will only count as one objection received.

If however each person sends in separate objections, even with similar content but clearly sent by different individuals, then each will count and the total number of objections received will be increased.

I hear I can send in more objections even if I have already made one, is this true ?

Yes.

There is no limit to points of objection you may submit.

Please make sure they are about ‘Material Considerations’ relevant to the planning application (please see elsewhere on this page for explanation of Material Considerations).
If say for example you had a realisation you didn’t have before, or become aware of information or facts you didn’t know before then submit further objections and both will be considered.

And you can always send them in by email or letter after the 11th September deadline
– please see ’11th September Deadline – Does it matter?’ for more information.

Can I send pictures and videos in with my Objections ?

Yes.

You can send them as attachments to emailed objections, or include pictures with posted or hand delivered objections.

You cannot attach/upload images when using the online IW Council Planning portal to object.

Objecting Online, has deadline passed

YES, unfortunately the deadline for online objections was 11th September.

YOU CAN STILL SUBMIT OBJECTIONS BY EMAIL OR LETTER after 11th September

Please click:

Westridge Farm spreads over two wards; Ryde East ward to the west, and Nettlestone and Seaview ward to the east.

The Westridge Farm farmhouse is located on the western edge of the farm and is in Councillor Lilley’s Ryde East ward.

How do I let the Press, Online News and Radio know how I feel about saving Westridge Farm ?

It is the Councillors on the Isle of Wight Planning Committee who will decide the 475 property planning application.

It is very IMPORTANT when contacting them to AVOID ACCUSATION OF LOBBYING and thus enable the councillors to not engage with your communication.

Please ensure you COPY YOUR COMMUNICATION TO ALL COUNCILLORS.

You could even copy in the PRESS AND MEDIA so they are also aware of what has been said to Councillors or what has been brought to their attention…
